Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Garden Glow platform at www.gardenglow.app (the "Service"). By creating an account, starting a trial, subscribing, or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. About us

The Service is operated by ACLT Limited (trading as Garden Glow) ("we", "us", "our").

2. Definitions

  • Consumer: an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
  • Business User: a user acting for purposes relating to their trade, business, craft or profession (including landscaping/driveway professionals).
  • Content: anything uploaded to or generated by the Service, including photos, prompts, generated images, and PDFs.
  • Generation: one AI image generation request resulting in output(s).
  • StreetGlow Campaigns: the bulk proposal feature for multiple addresses using publicly available street-level imagery (where available).
  • Stripe Customer Portal: Stripe's hosted billing portal used to manage payment methods, invoices and subscription details.

3. Who can use the Service

3.1 You must be at least 18 years old and able to enter into a legally binding contract.

3.2 If you use the Service on behalf of a company or organisation, you confirm you have authority to bind it to these Terms.

4. Account registration and security

4.1 You must provide accurate, up-to-date information and keep it current.

4.2 Authentication and user management are provided by Clerk. You are responsible for keeping your login credentials secure.

4.3 You must notify us promptly at support@gardenglow.app if you suspect unauthorised use of your account.

5. What the Service does (and does not do)

5.1 The Service lets users upload photos of outdoor spaces and submit text prompts to generate conceptual renovation visualisations. Users may also export PDF proposals.

5.2 The Service is not an architectural, engineering, surveying, structural, drainage, planning, or cost-estimation service. Outputs are conceptual only.

6. Plans, allowances and usage limits

6.1 Plans and allowances are described on our website and may include limits on generations, PDF exports, and feature access.

6.2 Allowances reset monthly for paid monthly plans, annually for paid annual plans (as applicable), and weekly for the free tier (as described below).

6.3 We may enforce technical limits to prevent abuse, protect the Service, or comply with law.

7. Free tier

7.1 The free tier currently includes:

  • 3 AI generations per week (resets weekly)
  • Watermarked PDF exports
  • No address-based image fetching
  • No StreetGlow Campaigns

7.2 We may change the free tier offering at any time.

8. Free trial (Agency tier)

8.1 We offer a 7-day free trial of the Agency tier, subject to:

  • Card required at signup
  • Trial limited to one per user account and one per payment card (fraud prevention)
  • Trial includes 30 AI generations total during the trial period (not the full Agency allowance)

8.2 Automatic conversion: unless you cancel before the end of the 7-day trial, your subscription automatically converts to Agency Monthly at £129/month.

8.3 Trial payment failure: if the first payment after trial fails, we will immediately cancel the subscription and downgrade to the free tier (no grace period for trial conversions).

9. Pricing, tax and payment processing

9.1 Prices are shown in GBP (£). Any applicable taxes (including VAT, where applicable) will be shown at checkout.

9.2 Payments are processed by Stripe. We do not store full payment card numbers on our servers.

9.3 Your payment relationship for billing is with Stripe; however, your contract for the Service remains with us.

10. Auto-renewal and billing cycles

10.1 Paid subscriptions auto-renew at the end of each billing period (monthly or annually).

10.2 You can manage payment methods, invoices, and billing details via the Stripe Customer Portal.

11. Upgrades, downgrades, cancellation and reactivation

11.1 Cancel any time: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.

11.2 Reactivation: You may reactivate a cancelled subscription before the period ends (where available via Stripe).

11.3 Upgrades: Plan upgrades take effect immediately. When you upgrade mid-billing-cycle, we apply a prorated credit for any unused time on your current plan. This credit is applied to your account balance and offsets your next invoice. You will be redirected to Stripe Checkout to confirm payment of the new plan.

11.4 Downgrades: Plan downgrades take effect at the end of the current billing period. When you are downgraded to the free tier, custom company branding and profile settings are reset to defaults. Your projects, uploaded images, and generated images are retained.

11.5 We do not provide refunds for unused time except where required by law or explicitly stated in our Refund & Cancellation Policy.

12. Payment failure, automatic retries, grace periods, chargebacks and disputes

12.1 Paid subscribers (Pro/Agency) payment failure:

  • We provide a 3-day grace period to resolve payment issues.
  • During the grace period, usage may be capped to 30 AI generations.
  • After 3 days, paid features may be blocked until payment is resolved.

12.2 Automatic payment retries: Our payment processor (Stripe) will automatically retry failed payments several times over approximately 3–4 weeks. If a retry succeeds, your subscription will continue and you will be charged the standard subscription fee. By subscribing, you authorise these automatic retry attempts. If you do not wish to be charged, you must cancel your subscription before a retry succeeds. You can cancel at any time from the Billing page or via the Stripe Customer Portal.

12.3 Final cancellation: If all automatic payment retries fail, your subscription will be cancelled and your account will be downgraded to the free tier.

12.4 Chargebacks/disputes: If you initiate a chargeback or payment dispute, we may immediately cancel your subscription and downgrade you to the free tier (no grace period).

12.5 Dispute fees: Stripe charges a dispute fee when a chargeback is initiated (commonly £15 in the UK, but this may vary). Legitimate disputes raised in good faith will not result in additional charges to you.

13. Refunds and cooling-off rights

13.1 Our approach to refunds is set out in our Refund & Cancellation Policy.

13.2 Important – digital services and the 14-day cancellation right: If you are a Consumer, you may have a 14-day cancellation right for online purchases.

13.3 By using the Service (including starting generations or exporting PDFs), you request immediate performance and acknowledge that you may lose your statutory right to cancel under the Consumer Contracts Regulations 2013, to the extent permitted by law and as presented at checkout and/or before first use.

14. User content, prompts and uploads

14.1 You retain ownership of the photos and other content you upload.

14.2 You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your uploaded content only as needed to provide and improve the Service and to meet legal obligations.

14.3 You confirm you have all necessary rights and permissions to upload content, including any permissions from third parties appearing in images (e.g., neighbours, identifiable individuals).

15. AI-generated outputs and your responsibility

15.1 AI outputs are generated from your inputs and third-party AI providers. Outputs may be unexpected, inaccurate, incomplete, or unsuitable.

15.2 You are responsible for reviewing outputs before relying on them or sharing them with third parties.

15.3 You must not use AI outputs to mislead others, including (without limitation) misrepresenting a property's condition in a real estate listing.

16. StreetGlow Campaigns and address-based image fetching

16.1 Address-based image fetching uses publicly available street-level imagery (where available) via Google Maps/Street View APIs.

16.2 You must only use StreetGlow Campaigns and any resulting proposals in a lawful manner, and in compliance with Google's applicable terms.

16.3 If you use address-based features for client work, you are responsible for ensuring you have a lawful basis to process any personal data involved (including address data where it relates to an identifiable person).

17. Acceptable use

17.1 You must comply with our Acceptable Use Policy.

17.2 We may suspend or terminate accounts that breach the Acceptable Use Policy or these Terms.

18. Intellectual property

18.1 We own all intellectual property rights in the Service, including the website, software, code, branding, and design (excluding your content).

18.2 Your uploads: You retain ownership of what you upload.

18.3 Generated images: We do not claim ownership of AI-generated images. Subject to these Terms and your subscription status, you receive a licence to use generated images and PDFs for personal and commercial purposes (e.g., client proposals and marketing).

18.4 You acknowledge that AI-generated outputs may resemble existing works, and you are responsible for ensuring your use does not infringe third-party rights.

19. Feedback

If you provide feedback or suggestions, you grant us a right to use them without restriction or compensation.

20. Availability, maintenance and support

20.1 The Service may be unavailable at times due to maintenance, updates, outages, or factors outside our control.

20.2 We do not guarantee uninterrupted availability.

21. Disclaimers

21.1 AI-generated images are conceptual visualisations only and are not professional advice, plans, or drawings.

21.2 Do not rely on outputs for construction decisions without consulting qualified professionals.

21.3 We do not guarantee feasibility, accuracy, legality, planning permission outcomes, or costs.

22. Limitation of liability

22.1 Nothing in these Terms limits or excludes liability that cannot be limited or excluded under law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

22.2 Subject to 22.1, and to the extent permitted by law, we are not liable for: indirect or consequential losses; loss of profit, revenue, business, goodwill, or anticipated savings; loss or corruption of data (except where caused by our failure to use reasonable care and skill).

22.3 Subject to 22.1, our total liability to you for all claims in any 12-month period will not exceed the greater of: (a) the total fees you paid to us in that 12-month period; or (b) £100 (if you are on the free tier).

22.4 If you are a Business User, you agree these limits are reasonable in light of the nature of the Service and fees paid.

23. Consumer rights

23.1 If you are a Consumer, UK consumer law provides legal rights that are not affected by these Terms.

23.2 For digital services, you may have rights if the Service is not provided with reasonable care and skill or is not as described.

24. Suspension and termination

24.1 We may suspend or terminate access if: you breach these Terms or the Acceptable Use Policy; we reasonably suspect fraud or misuse; required to comply with law or a regulator; you initiate a chargeback/dispute (see section 12).

24.2 We may remove or restrict content that violates these Terms or applicable law.

25. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (e.g., via email or in-app notice). Continued use after changes means you accept the updated Terms.

26. Complaints and dispute resolution

If you have a complaint, contact support@gardenglow.app and we will try to resolve it promptly. Consumers may also be able to use alternative dispute resolution (ADR) services if available.

27. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that Consumers may also bring claims in their country of residence within the UK where applicable.
